These Terms of Use ("Terms") govern your access to and use of the Fitly website, mobile application, and related services (collectively, the "Services").
By creating an account, accessing, or using Fitly, you agree to be bound by these Terms. If you do not agree, do not use the Services.
These Terms should be made available on the website and linked again during registration so that users can review them before creating an account.
Fitly is a financial organisation and money-management platform designed to help users track budgets, monitor expenses, plan debt repayment, monitor savings goals, manage tax reserve planning, track land-and-build planning, and organise Ajo/Esusu contributions.
The service is operated by Fitly Technologies Limited (RC 9592303), a private company limited by shares incorporated in Nigeria under the Companies and Allied Matters Act, 2020 on 4 June 2026.
Fitly is not a bank, not a deposit-taking institution, and not a money transfer service.

Where bank connection is available, Fitly uses a third-party provider such as Mono to access account and transaction information on a read-only basis for budgeting and financial planning purposes only.

By choosing to connect an account, you understand and agree that:

Fitly and its content, design, text, graphics, logos, software, workflows, and branding are owned by or licensed to us and are protected by applicable intellectual property laws.
Except for the limited right to use the Services in accordance with these Terms, no rights are granted to you in relation to Fitly's intellectual property.
You may not copy, adapt, reproduce, distribute, modify, publish, create derivative works from, or commercially exploit any part of the Services except as expressly allowed by us in writing or as permitted by law.
If you provide feedback, suggestions, or ideas about Fitly, you grant us the right to use and adapt that feedback without restriction or compensation, provided doing so does not override your non-waivable rights under applicable law.
We aim to keep Fitly available and reliable, but we do not guarantee uninterrupted or error-free service.
We may suspend, withdraw, restrict, or modify all or part of the Services for maintenance, updates, security reasons, legal reasons, or operational reasons.
Fitly is provided on an "as is" and "as available" basis to the fullest extent permitted by law.
To the fullest extent permitted by law, Fitly disclaims warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
Without limiting the above:
To the fullest extent permitted by law, Fitly and its founders, officers, employees, contractors, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, savings, goodwill, data, or business opportunity arising out of or related to your use of the Services.
To the fullest extent permitted by law, our total aggregate liability for claims arising out of or relating to the Services will not exceed the amount you paid to Fitly for the relevant Services during the 12 months immediately preceding the event giving rise to the claim, or NGN 50,000 if you have not made any payment to us, unless applicable law requires otherwise.
Nothing in these Terms excludes liability that cannot lawfully be excluded.

You may stop using the Services at any time. You may also request account closure, subject to legal, security, audit, or record-retention requirements.
Fitly may integrate with or contain links to third-party services, including bank-linking providers, payment processors, analytics services, cloud infrastructure providers, communication services, and AI providers.
We are not responsible for the acts, omissions, availability, content, or policies of those third parties except to the extent required by law.
We may update these Terms from time to time. If we make material changes, we may notify you through the website, app, email, or other reasonable means.
Your continued use of Fitly after updated Terms take effect means you accept the revised Terms.
These Terms are governed by the laws of the Federal Republic of Nigeria.
Any dispute arising out of or relating to these Terms or the Services will first be addressed in good-faith discussions between the parties. If the dispute is not resolved, the parties submit to the courts of competent jurisdiction in Nigeria, unless applicable law requires otherwise or the parties agree to another lawful dispute-resolution method.
